When a court decision is not enough
If you have succeeded in obtaining a decision in your favour (see further under Civil Procedure Law), then congratulations are in order. But beware: not every successful civil case leads to a successful enforcement. This, too, needs to be carried out professionally in order to be successful.
Unfortunately, there are more and more companies that try to avoid enforcement by means of various legal "tricks". These range from changes of domicile and the transfer of assets within the group to the initiation of probate and other reorganisation proceedings in order to get rid of debts. As a creditor, you then lose out twice over. On the one hand, you only get a fraction (or nothing at all) of your claim paid out. On the other hand, you have the expense of a decision in your favour. Here it is important to secure substratum for later enforcement from the beginning, for example by means of an attachment of assets worldwide.
